  Breaking news: Pre-nuptial agreements were given significant recognition in English law for the first time recently after a wealthy German heiress won a landmark legal battle with her former husband. Whilst the agreements are still not binding under English legislation (there is no provision for them under Section 25 of the 1973 Matrimonial Causes Act), it is definite that the courts will follow the Appeal Court decision, making prenuptial agreements more valid than ever before.

This pre-nuptial agreement, also called a pre-marital agreement is suitable for any couple, pre marriage. It provides that all property owned by each party prior to the agreement shall remain the property of that party in the event of separation and sets out what should happen to property acquired jointly after the date of the agreement. It also includes provision for other important  matters such as children, other assets and the matrimonial home. It states that neither party shall make any financial claim upon the other in the event of separation or divorce.

The courts are not obliged to enforce such agreements although they are more and more accepting of them.This straightforward agreement states that all property owned by each party prior to the marriage shall remain the property of that party in the event of separation or divorce and sets out what should happen to property acquired during the marriage.

Be sure to sign plenty of time before the marriage so that it can be proven that the contract was not signed under pressure (duress).
